The US Food and Drug Administration (FDA) classifies e-cigarettes and all related products as tobacco products. They regulate the sale, advertising, promotion, distribution, manufacture, import, packaging and labeling of e-cigarette products based on the laws set forth in the Tobacco Control Act and the Food, Drug, and Cosmetic Act (FD&C Act).
The Maryland Clean Indoor Air Act of 2007 does not explicitly mention vaping, but the state does allow local municipalities to enact laws regarding electronic cigarettes, so we recommend checking with the local government. It is assumed that ‘No Smoking’ signage that is posted in cities where vaping is restricted does apply to e-cigarette use also.
There are a large number of e-cigarette stores to be found throughout Maryland, mainly in and around the greater Baltimore area, with a smaller number also to be found throughout most other areas of the state.

Electronic nicotine delivery system means “an electronic device, a component for an electronic device, or a product used to refill or resupply an electronic device that can be used to deliver nicotine to an individual inhaling from the device [including] an electronic cigarette, an electronic cigar, an electronic cigarillo, an electronic pipe, and vaping liquid.” Md. Code Ann., Bus. Reg. § 16.7-101 (c) (2017)
Vaping liquid means “a liquid that: (1) consists of propyle glycol, vegetable glycerin or other similar substance; (2) may or may not contain natural or artificial flavors; (3) may or may not contain nicotine; and (4) converts vapor intended for inhalation when heated in an electronic device.” Md. Code Ann., Bus. Reg. § 16.7-101 (k) (2017)
Sale/distribution of “an electronic device that can be used to deliver nicotine to the individual inhaling from the device, including an electronic cigarette, cigar, cigarillo, or pipe” to minors prohibited (excluding FDA-approved “tobacco cessation products”). Md. Code Ann., Health-Gen. § 24-305(b) (2017)
